Terms and Conditions for Touring Pitches at Cherry Tree Springs

Introduction

Cherry Tree Springs is an adult only (18+) orientated park catering for touring caravans, trailer tents and motorhomes. Our guests’ enjoyment and safety is paramount and therefore we ask you to read and confirm the following Terms and Conditions before making your booking.


We reserve the right to ask guests who contravene these terms and conditions and Park Rules or, who in any other way are behaving in a manner likely to cause distress or nuisance to other visitors or our staff, to leave the park immediately. In these circumstances the holiday ceases and we shall not be liable for any costs incurred by you.

Access Statement

We seek to provide the very best service to all our guests and have a specially prepared access statement available on our website at www.springsholidayestates.co.uk which describes the facilities we have to offer on the park.

Contract

The contract is for a short-term holiday rental of a touring pitch made between the client and the owners of Springs Holiday Estates (“the owners”), binding from such time that booking is made and inclusive of all the following conditions.

By making a booking the client contracts on behalf of himself/herself and all those in his/her party and represents that he/she has the authority to accept these conditions on behalf of and binding upon all guests in his/her party.

Bookings are accepted on the understanding that the pitch is taken for holiday purposes only and that the number of people on each pitch is limited to that entered on the booking form and does not exceed the berthing limit of the booked accommodation.

The client and any friends or family of the client visiting the park while the client is staying there must adhere to the conditions of the contract, including these Terms and Conditions and the Park Rules.


The terms contained in this contract do not affect your statutory rights.

No person who has been convicted of a criminal sexual offence or is on the Sexual Offenders Register may stay at the park or be a visitor.

Booking conditions

We cater for adult families and couples and do not accept bookings from all male or all female parties of more than three persons. We also reserve the right to refuse any booking. The maximum permitted group booking is of 3 units with 2 adults per unit.

The booking is made based on 2 adults per caravan/motorhome/trailer tent. Additional adults may be included, with an extra charge, as long as you do not exceed the berthing limit of the caravan/motorhome/trailer tent and a maximum of 2 additional adults may sleep in a suitable awning.

You will receive a confirmation email of your booking which you agree to check and notify us of any incorrect information. We cannot be held responsible if you have not provided the correct or full information at the time of booking.

Where incorrect information has been provided by you we reserve the right to cancel your booking.

The person who makes the booking is responsible for the booking and warrants that they are over 18 years of age and that the party will not exceed the numbers stated on the booking application.

Day visitors must report to Reception on arriving at the park. There is a charge of £1.00 per visitor (not applicable to a visitor to a seasonal customer) and any vehicle must be left in the visitors car park area. Persons under the age of 18 are not permitted to visit the park.

No commercial vehicles or company liveried vehicles are permitted. Units up to a length of 8.3m can be accommodated, with a small number of extra length pitches available and all units must be in a safe roadworthy condition.

The information supplied at the time of booking will be stored on computer for administrative purposes. Under no circumstances will this information be provided to a third party.

The Price of the Holiday

Prices displayed on the internet by other 3rd party advertising media may not be current. The total price of the holiday will be calculated using our latest on-line tariff schedule held by Reception at Cherry Tree Springs at the time of booking.

The price of the holiday is for a pitch only; it includes the reasonable/fair use of electricity at the pitch – but does not include the charging of electric vehicles (via the hook up or through the tourer/motorhome).

It does not include a contribution to any other facilities or services the company may offer at the park or sister parks as these may be subject to local restrictions.

Once you have secured your booking through an accepted payment of a deposit, the price of the holiday will not be subject to any change unless the rate of VAT increases.


The balance of the price of your holiday must be paid no later than 14 days prior to your arrival and paid in full at the time of booking if the arrival date is less than 14 days from the booking date. If the balance is not paid in time then we are entitled to cancel the holiday and retain your deposit.


Deposits/Payments

A 15% deposit, based on the total holiday cost, is required when booking either on-line or directly with us. Full payment is required if arrival is within 14 days of booking. Deposit and full payments through the on-line booking process will be via Stripe and booking direct will be via card debit/credit payment.

Length of Stay

The minimum length of stay during bank holiday periods is 3 nights unless you are on a seasonal pitch.

Cancellation of the Holiday by you

You may cancel your holiday at any time. Cancellation will be effective on the date it is received by us. However cancellation charges are payable as follows:

  • 15 days and over – Deposit Only
  • 14 days and under – No Refund of Payment
  • Seasonal pitch booking – See Seasonal Booking Form

If you choose to cancel your holiday with us, you may be offered the option to move your booking to another available date within the same season. You will be required to pay any additional fees for different periods of the season which may be applicable.

The client is strongly advised to take out holiday cancellation insurance.

Change or cancellation of the Holiday by us

If we are unable to provide the booked holiday and have had to cancel your booking before the holiday is due to start, you are entitled to a full refund of the money you have paid.
It is regretted that no refunds can be given if guests depart prior to the end of the booked holiday, unless they do so as the result of the breach of some obligation on our part which would justify us cancelling the holiday.

Pitch Request

Whilst every effort will be made to allocate the pitch requested at booking we cannot guarantee a requested pitch and you may be required to pitch onto an alternative on arrival.

Holiday Behaviour Standards

By making a booking with us you have entered a contract in which you undertake, on behalf of yourself and the people in your party to adopt the following minimum standards of behaviour:

To act in a courteous and considerate manner towards us, our staff and other guests.

You further agree that you will not:

  • commit any criminal offence at the Park or undertake any criminal activity
– commit any acts of vandalism or nuisance
  • keep or carry any firearm or any other weapon at the Park
  • use any unlawful drugs
  • create any undue noise or disturbance
  • carry on any trade or business while on the Park
  • walk or drive over other occupied pitches
  • charge any electrical vehicle via the pitch hook up or tourer/motorhome socket outlets

Quiet hours are from 10.30pm until 8.00am. Please respect your fellow guests and keep noise to an absolute minimum.

Health and Safety

We take the wellbeing and safety of our guests very seriously and we ask that you comply with the following:

  • The maximum speed limit on the park is 10 mph
  • All vehicles must conform to the Road Traffic Act and have current tax, MOT and insurance. The provisions of the Highway Code apply to the roads on the park
  • All litter and refuse must be disposed of in the correct receptacles and not left at the pitch
  • No recreational vehicles can be used on the park. This includes motorised scooters and the like
  • No mechanical or repair work to vehicles is to be undertaken on the park
  • Only 1 vehicle can be parked next to the pitch. All other vehicles including trailers and boats must be parked in the visitors parking area
  • No unmanned drones or other aircraft are to be flown on the park without our express prior permission
  • In the unlikely event of a natural disaster or emergency requiring implementation of the park’s Emergency Action Plan you will be notified by voice
  • Please make yourself aware of the nearest fire point
  • You must observe and comply with all information or warning signs posted by us

Our full Health and Safety Policy is available, on request, at Reception.

Dogs and other pets

A maximum of 2 dogs are permitted per pitch.

If you bring your dog with you when you stay with us you must ensure that you:

  • Keep the dog on a short lead on the park at all times
  • Do not allow your dog to despoil or foul on the Park grounds
  • Use the designated exercise area and not the Park to exercise your dog
  • Clean up after your dog
  • Do not leave your dog unattended at any time

Other pets such as caged birds, cats etc may only be brought to the park with our prior agreement.

We reserve the right to require that the owner removes their dog, or any other pet, from the Park if it is, in our opinion, a nuisance or danger to other guests.

General

For security and safety reasons the park is closed to vehicle movement between 11.15pm and 7.00am during this period access is on foot only.

Open fires and ground level barbecues are not permitted.

Only Aertex type ground sheets are permitted on grassed areas.

The use of generators is not permitted.

Cutting or damaging trees and other vegetation is strictly prohibited and the natural conditions are not to be disturbed. This includes tying ropes to, or driving nails into, trees.


Pitches



The size of your unit must be stipulated at the time of booking to ensure that the allocated pitch is large enough. Should you subsequently alter your requirements we cannot guarantee to provide an appropriately sized pitch.

Every endeavour will be made to allocate guests the pitch of their choice, however, it must be clearly understood that acceptance of a booking is not conditional on the allocation of a particular pitch.



Your pitch number and directions to it will be confirmed on arrival. If you are in any doubt whether you are on the right pitch please check with a member of staff. Any guest on the wrong pitch may be required to move.



Pitching

You are advised to arrange an estimated time of arrival with Cherry Tree Springs Reception and inform them of any changes to that time to ensure somebody is available to show you to the correct pitch.



You are requested not to arrive before 13.00hrs and Sat to Thurs latest arrival time is 18.00hrs and Fridays up to 20.00hrs (not available after the 30th Sept each year) unless by prior arrangement. All pitches must be vacated by 12.00hrs on the day of your departure otherwise an additional late departure fee is payable.

Guests arriving outside of pitching times will be required to use the hook up outside the entrance barrier until our staff return to duty the following morning.

You will be directed to your pitch by a member of staff, please ask if you require assistance to pitch. You must pitch in the manner as instructed by the park staff. Failure to pitch correctly will result in you being required to re-pitch/adjust your unit.

Oversized awnings, tents and pods or independent structures not attached to the caravan or motorhome are not permitted at the park. The maximum size awning which can be erected is 3.5m from the unit. An awning is defined as a three-sided enclosure that provides additional floor space. It attaches by threading into the awning rail running along the sides and top of the caravan. A drive away awning is defined as an enclosure which connects it to the vehicle, with a connecting panel for direct access to the vehicle when the vehicle is connected the panel rolls away neatly to the side or top and when the vehicle is not connected the panel is closed down.

You must not encroach on other neighbouring pitches with vehicles, guy ropes, TV aerials etc, if you have any doubt you must contact reception for clarification.

No flags, banners, pendants or light poles are to be flown or erected at the pitch.

No industrial/composite wind breaks are to be erected and any windbreak must of a proprietary type and not positioned in such a manner as to obstruct other users of the park. Windbreaks may be required to be removed for grounds maintenance purposes.

Please note that should you wish to extend your stay beyond the booked dates there is no guarantee that the same pitch will be available.

Liability

The owners of Springs Holiday Estates are not liable for any loss or damage to any guests property or any property belonging to a member of the guests party howsoever caused.


Complaints



If you have a complaint about anything during your holiday please raise it with a member of our staff immediately at Reception and if you wish to pursue it following your departure please write to us within 28 days of your departure. However we do suggest that you try and complete a report about the complaint while you are on holiday.
