Privacy Notice – Spring Estates (Lincolnshire) Ltd

This privacy notice explains how we, Spring Estates (Lincolnshire) Ltd intend to collect and use information about you. For further information, please see our Privacy Policy found in each park reception, any update to this privacy notice can also be found here.

Under data protection law we are the ‘data controller’ of the personal information that we collect about you and as a data controller we have certain legal responsibilities concerning how we collect, use and share your personal information. We must inform you about this.

2. The information we collect

The types of personal information we collect from you include:

a) Contact Data – Personal information you provide to us including. your name, email address, phone number, postal address and pitch number.

b) Transaction Data – details of the transactions that you make with us and details of the services we provide to you including bank account details for example when making a standing order arrangement with us

c) CCTV images collected from our parks and facilities

3. How Do We Collect This Data

The information is collected from the details you give to us either in person, via the telephone, in writing or though e-mails or our website.

CCTV images are collected from numerous cameras located throughout the parks and held on secure digital recorders.

4. How we use your personal information

We may use your personal information in the following ways:

a) To provide our services effectively to you; to administer our services, including handling your requests, communicating with you (including about any offers or promotions); keeping up-to-date records about you and carrying out our obligations arising from any contracts entered into between you and us, to make payments to you and receive payments from you.

b) To directly market our own services to you by post and email. We will provide an option to unsubscribe or opt-out of further communication on any electronic marketing communication sent to you or you may opt out by contacting us using the details in the ‘Contact us’ section of this privacy notice. If at any time you do not want us to contact you for marketing purposes, you can let us know by contacting us using these contact details.

c) To provide for your and our security we will use the CCTV images to investigate any incident which takes place on our parks or in our facilities which may be a criminal offence or a breach of your Licence Agreement or Park Rules. Where the Police are duly authorised we may pass any CCTV images to them for the purposes of their investigation into a crime or possible crime.

5. Sharing and Transfers of personal information

We will share your Contact Data with East Lindsay District Council for the purposes of their investigations into applicability of Council Tax.

We share your Contact Data with finance providers where you have confirmed that this is required to fulfil your transaction of a caravan.

We work with carefully selected insurance intermediaries, who are regulated by the Financial Conduct Authority, to provide you with information about relevant insurance services. If we intend to pass your details to them we will obtain your consent. You can withdraw this consent at any time by contacting us and clearly letting us know.

We may be required to share your Contact or Transactional Data with our professional advisors and in some circumstances we may be legally required to share certain data held by us where, for example, we are involved in legal proceedings, where we are complying with other legal obligations, a court order or a governmental authority.

We confirm that all personal information held by us about you will remain in (and will not be transferred outside of) the United Kingdom.

6. How long will we keep your personal information?

We are subject to various regulatory and legislative requirements and, subject to the notes below we will keep your data as required for these statutory periods (usually 7 years).

Where you have expressed an interest in our products or services or where we have collected your contact details for us to provide you with information about our services, we will keep your information for no longer than 3 months.

Where you have purchased a product or service from us, we will keep your personal information for so long as you are sited on our park and for 10 years thereafter unless we are required to keep it longer to deal with any queries, complaints or legal claims that may arise.

We will keep your Contact Data for marketing purposes until you ask us to stop sending you such information save that we may keep these details on a “opt out” list in order to ensure that we do not market to you again.

7. Legal grounds to process

Generally we do not rely on consent for processing data other than in relation to sending third party marketing communications to you via email. Where we have sought and you have given consent for this you can withdraw your consent at any time by contacting us.

In all other instances we shall process your personal information on the basis that processing is necessary for:

a) Our legitimate business interests or those of a third party and these interests are not overridden by your interests or fundamental rights and freedoms in relation to the protection of your personal information. Our legitimate business interests include enabling us to provide you with products, services and information about our products and services (marketing). Third party legitimate business interests include the promotion of insurance services to you so that you have sufficient insurance coverage at our site(s) to meet your contracted obligations;

b) Our performance of a contract made with you. This includes our providing you with products and services and our taking steps at your request towards, and in anticipation of, providing you with products and services;

c) Our compliance with legal or regulatory obligations.

8. Your rights in relation to your personal information

If you have any questions in relation to our use of your personal information, you should first contact us using the contact in the ‘Contact us’ section of this privacy notice.

Under certain conditions, you may have the right to request us to:

  • provide you with further details on the use we make of your personal information;
  • provide you with a copy of personal information that we have collected about you;
  • update any inaccuracies in the personal information we hold;
  • delete any personal information that we no longer have a lawful ground to use;
  • object to our use of your personal information if our use of your personal information is causing you undue harm. In such a case we must cease using your personal information for that purpose.
  • Make a complaint to the Information Commission Officer about how we are using your data.
